1. BOOKING CONDITIONS
A booking is only final when all payments have been made and Polka Sailing has received the booking form. Provisional bookings will be held for a maximum of 7 days.

2. PREREQUISITES
By paying a deposit you are confirming that any course prerequisites have been meet and are happy you are prepared for the course.

3. PAYMENT
The deposit payable for any course or activity is non refundable and the remaining balance must be paid at least 28 days prior to the start of the course. If booking a course with less than 28 days to the start date the full course fee will be immediately due for payment.

4. AMENDMENTS TO BOOKINGS
Any alterations to the bookings must be made in writing. If in the opinion of Polka Sailing it is acceptable it will be accepted once written confirmation has been received. Changes of dates will only be acceptable if courses are running on those dates and there are available places and written confirmation is received by us up to 28 days prior to the commencement date. Within 28 days of the commencement date any change of dates will be considered a cancellation of those dates and cancellation charges will apply.

5. CANCELLATIONS
In the event of any cancellation more than 28 days before the commencement date of the course any monies paid EXCEPT the initial deposit will be refunded.
In the event of cancellations less than 28 days before the commencement date no refund will be payable and any outstanding amounts owed to Polka Sailing in accordance with Clause 3 will still be payable.
The date of cancellation is the date of the receipt of the written cancellation by Polka Sailing.

6. LIABILITY
6.1 Without prejudice to the customers payment obligations under Clause 3, to the maximum extent permitted by law, and taking into account the terms and conditions of this Agreement, each party’s aggregate liability to the other, or to any third party arising out of or in connection with this Agreement, whether in tort, contract or otherwise, shall be limited to the lesser of actual direct damages or payment made.

6.2 Neither party shall be liable to the other or to any third party for any consequential, incidental, indirect, punitive, special or similar damages

7. ALTERATIONS
In the event of a course being cancelled by Polka Sailing for whatever reason, our students will have the option of accepting any alternative provided or having a full refund of all monies paid. In any event our liability will be limited to monies already received from you in respect of that course and will cease upon repayment of such monies.

8. LIMITATION
Any claim arising from or in connection with this Agreement to be brought by one party against the other shall be brought within six months of the completion date of the course, failing which such claims shall be time-barred.

9. SEVERANCE
The invalidity in whole or in part of any clause in this Agreement shall not affect the validity of the remainder of such clauses or this Agreement.

10. LAW AND JURISDICTION
This agreement shall be governed by and construed in all respects in accordance with the Laws of England and shall be subject to the exclusive jurisdiction of the English Courts.

The Day Skipper and Coastal Skipper / Yachtmaster Online courses are provided by Navathome and are therefore subject to the terms set out below:

Payments
Payments for course fees are due, in full, at the time of enrolment.
Payment can be made by bank transfer, online. by telephone or by cheque in GBP, drawn on a UK bank.
In the case of payment by cheque we reserve the right to allow the cheque to clear before dispatching your student pack.
Once payment has been made and confirmed students will be sent the student pack and be supplied with the log in information to access the online course.
Local taxes and import duties are not included and may be added by customs for deliveries outside the UK.

Postage
The student pack will be sent on the next working day and delivery to the UK and sone european countries is included in the course price.
Additional fees may be applied to addresses outside of these areas.
All packs are sent with tracking information and should be signed for. All packs sent by currier must be signed for.
Navathome will not be held responsible for any duty or expenses incurred in the country of delivery.

Packs sent to Care Of addresses.
Navathome will not be held responsible for pack sent to ‘care of’ address of any type including business, marinas etc.
Replacement packs for those lost after delivery will be at the sole expenses of the purchaser including postage and handling fees.

Pack contents.
Pack contents must be checked on arrival. I list of the contents is in your readme file available from your main menu page.
No replacements for breakages or missing items will be made after the seven day returns period.

Course expiry
There is an initial access period of 6 months which is plenty of time to complete any of the courses offered.
Your access can be extended at any time for up to two years after your access runs out for an admin fee of £30
Access lapses completely if your course has run out and you have not extended within the following two years.

Once a student has passed the assessment their course is complete and their access terminated.

Internet access
Students must have access to the internet and email to complete the course.

Users
The course is not transferable and access is for the applicant only.

Compatibility
Please check that the free trial runs on your device before booking.
The courses do not use a platform so work on most devices including ipad, Iphone, PC, Mac, Android etc.
There some issues with the free chart plotter simulator provided by the RYA. It works on PC and Mac but not on mobile devices. It is not essential to the courses so can be worked around if a student does not have access the PC based units.

Pre course knowledge
Students should be at the correct level for the course being taken. No previous experience is required to take the Day Skipper theory course, Day skipper level theory is required for the Coastal/Yachtmaster theory and Coastal/Yachtmaster theory is required before taking the RYA Ocean theory.
Navathome reserves the right to change a course from Coastal Yachtmaster to Day Skipper if it becomes apparent that the student does not have the required pre course knowledge and the student does not hold a current Day Skipper theory certificate.

What we provide
We will provide online back up and land line telephone backup as required by each student and every endeavor will be made to help students achieve their aims.
We will not disclose information about students unless we are legally obliged to do so or a student has agreed in writing in advance.
By enrolling you confirm that we may hold necessary business information about you including your name, address, course booking, payment and course record. No credit card information is held by Navathome.
Any contract between you and us shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute.
All dealings, correspondence and contact between us and you shall be made or conducted in the English language.
Every effort has been made to ensure the accuracy of course information. However, we cannot accept any liability for errors, omissions or inaccuracies in the course content.
We continuously improve the course content and we do welcome any feedback from students which improve the quality of the course.
